Jonito Terms of Use

1. Service Editor

2. Conditions of access and majority

You must be at least 18 years old to create or use a Jonito account. Accounts belonging to minors are not allowed. By using the service, you represent that you are at least 18, legally able to accept these terms, and not prohibited from using a dating service by a court order or other mandatory rule.

Any account identified as belonging to a minor may be immediately suspended or closed. Where there is reasonable doubt about age, Jonito may request verification solely to confirm adulthood.

An account is personal. You must not transfer, sell or share access to it, or create an account for another person.

3. Account Accuracy and Identity

You must provide information in good faith and not impersonate any person, organization or other member. The use of a nickname is authorized when the application provides for it.

Any profile or identity verification constitutes an additional measure of trust but does not guarantee the identity, intentions, background or future behavior of a member.

4. Nature of the service

Jonito allows you to create a profile, discover members, publish certain content, exchange messages, use private albums, report or block people, and access free, advertising or paid features.

Jonito does not guarantee a number of matches, a meeting, or compatibility between members. Each user remains responsible for their interactions and decisions.

5. Rules of behavior

You must use Jonito with respect for other members, their consent, their privacy and the law.

• Harassment, threats, intimidation, hatred, discrimination, blackmail, extortion, doxxing or unauthorized disclosure of personal data are prohibited.
• The following are prohibited: fraud, scams, phishing, false and misleading profiles, identity theft, unauthorized commercial solicitations, spam or manipulation of Jonito systems.
• Prohibited: sexual exploitation, organized prostitution or facilitation of illegal activities, trafficking in human beings, illegal drugs or goods, content promoting serious crimes.
• Any sexual content involving a minor, any attempted sexual contact with a minor, any depiction of sexual abuse of a minor or any non-consensual content is strictly prohibited and may be reported to the appropriate authorities when required by law.
• You must not post content that infringes the copyright, publicity, privacy or other rights of any third party.
• You must not circumvent security measures, massively extract data, improperly automate interactions, attempt to access third-party accounts or disrupt the operation of the Service.

6. Photos, videos, posts and public content

Public content must remain compatible with a mainstream dating app and with app store rules. Pornographic or explicitly sexual content, nudity prohibited by our moderation rules and illegal content may be removed.

Jonito may use automated tools and human controls to detect or limit certain content. An automated security decision may be reviewed when human review is appropriate.

7. Private albums and intimate content

A private album is visible only to its owner and the members to whom it grants access, subject to security needs, moderation or a legal obligation.

You should only upload content that you have the right to share and for which all identifiable individuals have given consent where consent is required. Non-consensual intimate content, content involving minors and illegal content are prohibited, even in a private space.

The application may limit screenshots and display a watermark, but no technical measures can guarantee that a recipient will never reproduce content by another device. Do not share media if copying it by the recipient would create a risk that you do not accept.

8. Messaging and Consent

Messages must follow the same rules as public content. Refusal, blocking or lack of consent must be respected. Repeated harassment, unwanted sexual requests and sending unsolicited intimate content may result in sanctions.

Locally deleting a message or conversation may only delete your own view when the interface specifies it.

9. Geolocation and personal security

Proximity Features should not be used to track, precisely locate, intimidate, or surveil another Member. The Jonito map displays a deliberately approximate position and not the exact GPS position of another user.

During a first meeting, we recommend choosing a public place, informing a trusted person and keeping your own means of transport or departure. Jonito is not an emergency service.

10. Reporting, blocking and moderation

You can report a member or content and block a user. Jonito may review reports, limit account visibility, remove content, temporarily suspend or close an account for violations of these terms, risk to the community, or legal obligation.

When several consistent signals indicate a serious risk, an automatic preventive suspension may be applied before human examination. Important decisions can be re-evaluated based on available evidence.

11. Moderators

Some members may be appointed as moderators or lead moderators. This role may be revoked, creates no vested right, and requires in particular impartiality, confidentiality and compliance with Jonito procedures.

An active moderator may receive certain Premium benefits free of charge for as long as the role remains active. The benefit ends when the role is removed or suspended and is not a purchased subscription.

12. Premium, Credits and Rewarded Ads

Jonito may offer a Premium subscription, credits or other in-app purchases as well as temporary benefits obtained after viewing a rewarded advertisement.

Applicable prices and benefits are those displayed at the time of purchase or activation. Credits and benefits are usage rights internal to the service, do not constitute currency, are not transferable unless otherwise indicated, and cannot be converted into cash.

Rewarded advertising must be validated by the mechanism provided to trigger the benefit. Any attempt at fraud or circumvention may result in forfeiture of the reward or security measures.

13. App Store and Google Play purchases

Mobile purchases are billed by Apple or Google depending on the platform used. The applicable store's payment, auto-renewal, cancellation and refund policies apply. When the law imposes an additional right on the consumer, this right remains applicable.

On iOS, Apple's standard terms may also apply when required by the store. In the event of a conflict, the mandatory rules of the store or the law shall prevail to the extent necessary.

14. Advertising

The free version or certain features of Jonito may contain advertising. Ad availability, format and personalization may vary by country, consents, device and platform settings.

15. Your content and technical license

You remain the owner of your rights to the content you create. By uploading them, you grant SAS Clyb a non-exclusive, worldwide license limited to the duration necessary to host, technically reproduce, adapt to the format, display and transmit this content solely in order to exploit, secure, moderate and provide Jonito.

This license ends when the content is deleted and is no longer necessary for the service, subject to temporary backup copies, legal obligations and the elements necessary to resolve a dispute or report.

16. Intellectual property of Jonito

The brand, logo, interface, software, graphics and content produced by Jonito or SAS Clyb are protected by applicable rights. No ownership rights are transferred to you solely by virtue of your use of the service.

You may not unlawfully copy, resell, decompile, commercially reproduce, or exploit any copyrighted material on the Service beyond what is permitted by law.

17. Account suspension and closure

We may take proportionate action in the event of a breach of these terms, fraud, serious risk to others, technical circumvention or legal obligation. These measures may include warning, restriction, removal of content, suspension or closure of the account.

Where compatible with security, the law and the prevention of abuse, we may provide information on the action taken and allow for a challenge or reconsideration.

18. Voluntary deletion and reactivation

You can request the deletion of your account from Jonito. The account is then hidden and permanent deletion is scheduled 30 days later. During this period, the reactivation mechanism allows you to undo the deletion.

After the expiration of the period, the data provided for by our purge procedure is deleted, subject to the information whose retention remains legally necessary.

19. Availability and evolution of the service

We may develop Jonito, correct errors, modify certain functionalities or temporarily interrupt the service for maintenance, security or technical reasons. We do our best to ensure reasonable availability without guaranteeing uninterrupted operation.

An experimental, free or ad-supported feature may be modified or withdrawn, subject to rights attached to purchases already made and applicable law.

20. Responsibility and safety of meetings

Jonito provides a networking platform and is not a party to personal relationships between members. We cannot guarantee the behavior, statements, identity or intentions of any user.

Nothing in these conditions excludes or limits any liability which cannot lawfully be excluded. Within the limits permitted by law, SAS Clyb is not liable for damage resulting from behavior of another user that Jonito could not reasonably prevent despite the security measures implemented.

21. Applicable law and consumers

These conditions are governed by French law, without depriving a consumer of the mandatory protections he benefits from in his country of residence when these rules are applicable.

Before any dispute, you can contact contact@esimdual.com to seek an amicable solution. The mandatory rules of jurisdiction remain applicable.

22. Modification of conditions

We may update these conditions to take into account changes in service, security, business models or regulations. The update date appears at the top of the document. When an important change requires new acceptance, Jonito may ask you for it before continuing to use certain features.
